Abstract: (64 Views)
The Iraq-Iran War (1980-1988) was one of the longest and bloodiest wars of the 20th century. This war not only caused great loss of life and property to both countries, but also left long-term effects and consequences. One of the most important of these consequences is the widespread contamination of Iranian soil with war mines. More than three decades after the end of the war, these mines continue to pose a serious threat to the lives and property of the Iranian people and have hindered the economic and social development of the contaminated areas. One of the unfortunate aspects of this war is Iraq's indiscriminate use of anti-personnel mines, which has caused significant loss of life, property, and the environment. This research attempts to assess the feasibility of the Iranian government's lawsuit in international and national courts by examining the legal and political (non-legal) dimensions and whether the Iranian government can, based on the rules of international law, sue Iraq in the International Court of Justice or other competent international authorities in order to compensate the victims for the damages caused by war mines.
