fa جنبه‌ها و آثار جهانی شدن حقوق کیفری و حقوق بشر پژوهشي Research <div style="text-align: justify;"><span style="font-size:14px;"><span style="line-height:2;"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="font-family:&quot;Times New Roman&quot;,serif"><span style="color:#00000a"><span lang="AR-SA"><span style="font-family:&quot;B Zar&quot;">جهانی شدن، به‌عنوان یک فرآیند تحول‌آفرین، جنبه‌های گوناگون زندگی بشر را دستخوش تغییر کرده و تأثیرات عمیقی بر حوزه‌های حقوق کیفری و حقوق بشر بر جای گذاشته است. در این پژوهش، به بررسی تأثیرات جهانی شدن بر حقوق کیفری و حقوق بشر پرداخته شده است. جهانی شدن حقوق کیفری، علاوه بر ایجاد سازوکارهای همکاری بین‌المللی، به هماهنگ‌سازی نظام‌های کیفری ملی و تقویت تعاملات میان دولت‌ها در مقابله با جرایم فراملی، مانند تروریسم، قاچاق انسان و جرایم سایبری منجر شده است. این فرآیند، در عین حال، چالش‌هایی مانند تعارض با حاکمیت ملی و تفاوت‌های فرهنگی را نیز به همراه داشته است. در حوزه حقوق بشر، جهانی شدن باعث تقویت اصول جهان‌شمول و کاهش اقتدار مطلق حاکمیت ملی گردیده است. نقش نهادهای بین‌المللی و اسناد حقوق بشری در ایجاد استانداردهای مشترک و الزام‌آور، نشانگر اهمیت این حوزه در نظم جهانی است. با این وجود، موانعی همچون نسبیت فرهنگی و مقاومت برخی دولت‌ها در پذیرش این اصول، همچنان وجود دارد. پژوهش حاضر نشان می‌دهد که جهانی شدن حقوق کیفری و حقوق بشر، ضمن فراهم ‌آوردن فرصت‌هایی برای تحقق عدالت و امنیت جهانی، نیازمند تعادلی میان الزامات جهانی و ارزش‌های محلی است. این پژوهش بر اهمیت تقویت همکاری‌های بین‌المللی، احترام به تنوع فرهنگی و تقویت نهادهای نظارتی تأکید دارد و راهکارهایی برای دستیابی به جامعه‌ای عادلانه‌تر و انسانی‌تر ارائه می‌دهد.</span></span></span></span></span></span></span></span></div> <div style="text-align: justify;"></div> <div style="text-align: justify;"><span style="line-height:2;"><span style="font-size:14px;"><span style="unicode-bidi:embed"><span style="font-family:&quot;Times New Roman&quot;,serif"><span style="color:#00000a">Globalization, as a transformative process, has profoundly influenced various aspects of human life, leaving significant impacts on the domains of criminal law and human rights. This study examines the effects of globalization on these fields. The globalization of criminal law has led to the establishment of international cooperation mechanisms, harmonization of national legal systems, and enhanced interactions among states to combat transnational crimes such as terrorism, human trafficking, and cybercrimes. However, this process has also brought challenges, including conflicts with national sovereignty and cultural differences. In the realm of human rights, globalization has strengthened universal principles and reduced the absolute authority of national sovereignty. The role of international institutions and human rights instruments in creating shared and binding standards highlights the importance of this field in global governance. Nonetheless, obstacles such as cultural relativism and resistance from certain states in adopting these principles remain. This study demonstrates that the globalization of criminal law and human rights, while offering opportunities for achieving global justice and security, requires a balance between global requirements and local values. The research emphasizes the importance of enhancing international cooperation, respecting cultural diversity, and reinforcing supervisory institutions.
