fa بررسی ابعاد مفهوم کرامت ذاتی در حقوق معاصر پژوهشي Research <div style="text-align: justify;"><span style="line-height:2;"><span style="font-size:14px;"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><span style="color:#00000a"><span lang="AR-SA"><span b="" style="font-family:" zar="">جستار تحقیقی حاضر با رویکرد قیاسی و با روش تحلیلی ـ توصیفی، بر آن است تا سازوکارهای همزیستی مبانی فلسفی اصل کرامت انسانی را با رویه حقوقی، در اسناد تقنینی و همچنین ذیل تصمیمات قضایی، تحلیل کند. با توجه به جنبه‌های متافیزیکی از کرامت ذاتی انسان که همچنان نیز ادامه دارد، اصل کرامت انسانی، فرصت مغتنمی را برای نقد قوام‌یافته و انسجام بخشی این اصل در آثار قانون‌گذاری، به‌ویژه در تصمیمات قضایی باز می‌کند. در نهایت در پایان تحقیق چنین نتیجه‌گیری می‌شودکه گرچه کرامت ذاتی یک فضیلت جهانی است، اما محتوای آن تا حد زیادی به موقعیت‌های اجتماعی، مذهبی و سنتی جوامع خاص بستگی دارد. از این حیث پاسداشت کرامت ذات ذیل حقوق شهروندی به‌عنوان حقوق بشر جمعی معنا می‌یابد. کرامت انسا</span></span><span lang="FA"><span b="" style="font-family:" zar="">ن</span></span><span lang="AR-SA"><span b="" style="font-family:" zar="">ی با تمامیت جسمی، اجتماعی و روانی یک فرد مرتبط می‌باشد اما با وجود تفاوت‌های آشکار در درک کرامت، به نظر می‌رسد یک هسته مشترک برای ایده کرامت معرفی گردیده است. هسته اصلی کرامت شامل سه عنصر است: 1) ارزش ذاتی همه انسان‌ها، 2) به رسمیت شناختن و احترام به ارزش ذاتی توسط دیگران، و 3) وظیفه دولت‌ها در پاسداشت و تکریم آن به‌عنوان اصل مسلم حقوقی. علی هذه رعایت کرامت انسان به سبب به ما هو انسان بودن وی برای حمایت از حقوق بشر، اهمیت خاص دارد.</span></span></span></span></span></span></span></span></div> &nbsp; <div style="text-align: justify;"><span style="font-size:14px;"><span style="line-height:normal"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><span style="color:#00000a">The current research paper, with hiring a comparative approach, aims to analyze the coexistence mechanisms of the philosophical foundations of the principle of human dignity with legal procedures, in legislative instruments and also under judicial decisions. Considering the metaphysical aspects of the inherent human dignity that still continues, the principle of human dignity opens up a great opportunity to criticize the consistency and coherence of this principle in legislative works, especially in judicial decisions. Finally, at the end of the research, it is concluded that although inherent dignity is a universal virtue, its content largely depends on the social, religious and traditional situations of certain societies.
