fa مبانی اعلامیه حقوق بشر اسلامی در نظم حقوقی کنونی پژوهشي Research <span style="font-family:Tahoma;"><span style="font-size:14px;"><span style="line-height:2;"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="color:#00000a"><span lang="AR-SA">از آنجایی که اسلام از حیث حقوقی دارای موجودیت مستقل است و منابع متعدد فقهیه در رابطه با حقوق انسان (حقوق بشر)، متضمن اصول، قواعد، موازین و ارزش‌های والایی است و اندیشمندان اسلامی، دیدگاه‌های قابل توجهی در این خصوص بیان داشته‌اند، کشورهای اسلامی درصدد این مأموریت برآمدند تا اعلامیه‌ای مستقل از منظر حقوق بشر اسلامی ارائه کنند. سرانجام اعلامیه‌ای در شهر قاهره مصر توسط کشورهای اسلامی به تصویب رسید که اکنون محل بحث، تبادل نظر، آسیب‌شناسی و تطبیق با دیگر اسناد ملی، منطقه‌ای و جهانی به‌ویژه در قالب اعلامیه‌ها و کنوانسیون‌ها است. یقیناً حقوق بشر با نگاه غربی، زاویه خاصی از بینش حقوقی را دربر دارد که بعضاً نه‌تنها با فرهنگ‌ها، سنت‌ها و موازین شرعی در تضاد است، بلکه بعضاً آشکارا انسان را از جایگاه معنوی و ارزش‌های حاکم بر آن دور می‌کند. حقوق ملی کشورهای اسلامی نیز در موارد متعددی، اراده را بر تضمین حقوق انسان‌ها گذاشته است. باید دید حقوق ایران چه رویکردی در قبال آن اعلامیه دارد و تفسیر آن با توجه به قواعد تفسیری حاکم بر حقوق ایران چیست و چه نواقص، معایب و محاسنی دارد؟ در این مقاله، مبانی حاکم بر مواد 10-1 اعلامیه حقوق بشر اسلامی به شیوه مرسوم &laquo;تفسیر ماده به ماده&raquo; مورد تبیین و تفسیر قرار گرفته است.</span></span></span></span></span></span></span> <span style="font-size:14px;"><span style="font-family:Tahoma;"><span style="line-height:2;"><span style="unicode-bidi:embed"><span style="color:#00000a">Since Islam has an independent existence in terms of law, and numerous jurisprudential sources regarding human rights (human rights) include principles, rules, standards, and high values, and Islamic thinkers have expressed significant views on this matter, Islamic countries They sought this mission to present an independent declaration from the perspective of Islamic human rights. It should be seen what is the approach of Iranian law towards that declaration and what is its interpretation according to the rules of interpretation governing Iranian law and what are its shortcomings, disadvantages and merits?
