fa آموزه‌های اخلاقی جرم‌شناسی اصلاح و درمان در خوانش اسلامی؛ با تأکید بر آرای امام خمینی (ره) Moral Teachings of Criminology, Correction and Treatment in Islamic Reading; With Emphasis on The Opinions of Imam Khomeini (RA) پژوهشي Research عدالتِ کیفری به ابزارهایی مثل «عدالتِ بدون کیفر» هم نیاز دارد. «دعوت به تنفر» و نگاه تنفرآمیز نسبت به انسان‌های مجرم شده و خطاکار ریشه در حاکمیت جرم‌شناسی‌ها و نظام‌های حقوقیِ بدون خدا ـ عاری از خدا و معارض با خدا در جوامع دارد. یقیناً احترام به حقوق انسانی و قضاییِ زندانیان و تلاش برای اصلاح و بازپروری آنها، فضیلتی اخلاقی و آرمانی تعالی‌آفرین در قلمرو نظام حقوق‌کیفری و جرم‌شناسی اصلاح‌مدار بوده که در کلام و اندیشه‌های حقوقی ـ قضایی امام خمینی (ره) صریحاً و مکرراً مورد تنفیذ و تأکید قرار گرفته‌ است.        اخلاقی بودن و هم‌راستاییِ فلسفی ـ منطقی با الزامات اخلاقی به برنامه‌های اصلاحی در حق زندانیان مشروعیت و اعتبار می‌بخشد. پیش‌فرض ما این است که اصلاح اخلاقیِ زندانیان سنگ‌بنای جرم‌شناسی اصلاح‌مدار و جزء لاینفک آن است. در این میان، با بررسی توصیفی ـ تحلیلی موضوع، دریافتیم که عمل به الزامات اخلاقی نظیر احترام به ارزش‌های اخلاقی در اجرای قواعد مددکاری اجتماعی در زندان، صداقت در روش و شیوۀ برخورد، سازگاری وسایل (برنامه‌های اصلاحی) با هدف، مصلحت‌گرایی، استوار ‌ساختنِ ارزش‌های معرفتی و دینی در میان زندانیان و نفی اجبارگراییِ مفسده‌زا و معارض با ارادۀ آزاد محکومان، می‌تواند به اجرای هدفمند و بینش‌مندِ سیاست اصلاح زندانیان کمک نموده و بر کارایی و اعتبار آن بیفزاید.   Criminal justice also needs tools such as "justice without punishment". "Invitation to hate" and the hateful view towards guilty and wrongdoing people is rooted in the rule of criminology and legal systems without God - devoid of God and opposed to God in societies. Certainly, respecting the human and judicial rights of prisoners and trying to reform and rehabilitate them is an excellent moral virtue and ideal in the realm of the reform-oriented criminal law and criminology system, which is explicitly and repeatedly emphasized in the words and legal-judicial thoughts of Imam Khomeini (RA). has taken. Ethicality and philosophical-logical alignment with moral requirements gives legitimacy and validity to the correctional programs for prisoners. Our premise is that the moral reformation of prisoners is the cornerstone of reformist criminology and its integral part.
