fa راهبرد سیاست جنایی اسلام در تضمین حقوق سلامت محکومان؛ جلوه‌ای از حقوق بشر اسلامی Islamic Criminal Policy Strategy in Guaranteeing The Health Rights of Convicts a Manifestation of Islamic Human Rights پژوهشي Research حقوق بشر حقوقی است که تمامی انسان‌ها فارغ از هرگونه نژاد، رنگ، جنس و سایر تمایزات ظاهری و درونی از آن برخوردار هستند، برخورداری از این حقوق که در دین اسلام بر آن تأکید شده نشان از کرامت انسانی را در پی دارد؛ لذا اصل کرامت انسانی که اصلی تعیین‌کننده در ارتباط با وضعیت و چگونگی رفتار با محکومان می‌باشد برخورداری از حقوق سلامت را برای محکومان به رسمیت شناخته است. لذا هدف از پژوهش حاضر بررسی راهبرد سیاست جنایی اسلام در تضمین حقوق سلامت محکومان به‌عنوان جلوه‌ای از حقوق بشر اسلامی است. این تحقیق از نوع نظری بوده و روش تحقیق به‌صورت توصیفی ـ تحلیلی است و روش جمع‌آوری اطلاعات به ‌صورت کتابخانه‌ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. یافته‌ها پژوهش حاکی از این است که در میان بسیاری از مبانی حقوق بشری که در عصر حاضر مورد تأکید نهادها و اسناد بین‌المللی قرارگرفته است، در قوانین جزایی اسلام چه به‌ صورت عام و چه به‌ صورت خاص مورد توجه بوده است. از آن جمله حمایت از حقوق محکومان که از بنیادهای اساسی دین اسلام مبنی بر حفظ حیات و محترم شمردن و حفظ کرامت انسانی نشئت گرفته که این امر با مفهوم حقوق بشر اسلامی نیز دارای هماهنگی تام می‌باشد. آنچه بدیهی می‌نماید این است که در چنین شرایطی، قواعد و مقررات مربوط به رفتار با محکومان، در میراث حقوقی اسلام، مورد توجه بوده است. چندان‌که می‌توان گفت رعایت حقوق محکومان همواره درآیات قرآن، روایات و سیره پیامبر (ص) و ائمه (ع) مورد تأکید قرار گرفته است. درنتیجه بررسی توأمان حقوق محکومان در حقوق جزای اسلامی و نظام کیفری ایران نشان از این دارد که نظام کیفری ایران منبعث از حقوق اسلامی، در رابطه با رعایت حقوق محکومان و نیز شرایطی که لازم است تا حقوق بشر محکومان رعایت گردد در مجموعه قوانین کیفری با یکدیگر مشابهت دارند. تا آنجا که اصولی نظیر اصل حقوق بشری و رفتار منطبق با کرامت انسانی که با محکومان شکل‌گرفته است نشان‌دهنده توجه ویژه دین اسلام بر حقوق بشر اسلامی سال‌ها قبل از تصویب اعلامیه‌ها و اسناد بین‌المللی حقوق بشر در ارتباط با حقوق سلامت محکومان است. Human rights are rights that all human beings have, regardless of race, color, gender, and other external and internal distinctions. Having these rights, which are emphasized in Islam, is a sign of human dignity. Therefore, the principle of human dignity, which is the determining principle in relation to the situation and how to treat convicts, has recognized the right to health for convicts. Therefore, the purpose of this research is to examine the strategy of Islamic criminal policy in guaranteeing the health rights of convicts as a manifestation of Islamic human rights. This research is of a theoretical type and the research method is descriptive-analytical and the method of collecting information is library-based and was done by referring to documents, books and articles. The findings of the research indicate that among the many fundamentals of human rights that have been emphasized by international institutions and documents in the present era, they have been considered in Islamic penal laws, both in general and in particular. Including supporting the rights of convicts, which originates from the basic foundations of the Islamic religion of preserving life and respecting and preserving human dignity, which is in complete harmony with the concept of Islamic human rights. What is obvious is that in such a situation, the rules and regulations related to the treatment of convicts have been considered in the legal heritage of Islam. So much so that it can be said that respecting the rights of convicts has always been emphasized in the verses of the Qur'an, the traditions and the life of the Prophet (PBUH) and Imams (PBUH). As a result of examining the twin rights of convicts in Islamic penal law and the Iranian penal system, it shows that the Iranian penal system is derived from Islamic law, in relation to respecting the rights of convicts, as well as the conditions that are necessary to respect the human rights of convicts in the set of criminal laws with They are similar to each other.
